GardePro Terms
Thank you for using GardePro Mobile or Web Application(hereafter called "Platform" or "App"), with the web app URL being [https://webapp.gardepromobile.com], provided by Shenzhen Zhuopu Digital Technology Co., Ltd. (GardePro, we, or us, or our)! We hope you enjoy your visit, and find that using our Platform is helpful.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING GARDEPRO APP.
Article 1 - ACCEPTANCE OF TERMS OF SERVICE
This agreement is between owner and operator of "GardePro" application (hereafter called "we", "We" or "platform"), and you (hereafter called "you", "You" or "User"), a user of the platform.
By using the Platform, including the services offered on the Platform and all other services, software, application and subscription offered by GardePro (hereafter collectively referred to as the "Services"), you acknowledge and agree to these terms of service ("Terms of Service") and to GardePro's Personal Information Protection Policy, which is accessible hereunder and is incorporated to this agreement by reference. If you do not agree with those Terms of Service and Personal Information Protection Policy, you may be not able to use the Platform.
Article 2 - GARDEPRO RESERVES THE RIGHT TO CHANGE TERMS
GardePro may revise and update the Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Platform thereafter. Your continued use of the Platform following the posting of revised Terms means that You accept and agree to the changes. While GardePro expects to notify all users via e-mail of updates to the Terms, You are expected to check this site frequently so You are aware of any changes, as they are binding on You. These Terms may not otherwise be amended or modified except in a writing signed by You and GardePro. You acknowledge and grant us permission to communicate with you by text, email, push messages, and telephone, for any purpose that we determine to be relevant, for example, providing Platform support, providing Platform updates or messages, service announcements, and marketing messages, provided that telephone communications will only be used for Platform support, if appropriate.
Article 3 - GARDEPRO RESERVES THE RIGHT TO UPDATE PLATFORM
GardePro may from time to time in its sole discretion develop and provide Platform Updates, for reasons including but not limited to certain progress in technology, meeting the requirements or feedbacks from users, or to improve the use experience of the users. But you acknowledge and agree that GardePro has no obligation to provide Updates or to continue to provide or enable some particular features or functionality. Depending on Your individual settings, Updates to the Platform may automatically download and install, or You may receive notice of or be prompted to download and install available Updates.
Please promptly download and install all applicable Updates. And you acknowledge and agree that there is possibility that the Platform or portions thereof may not properly operate if you fail to do so. You further agree that all Updates will be deemed part of the Platform and be subject to all terms and conditions of this Agreement.
Please also be noted that certain Updates may cause the Platform inoperable, inaccessible, and/or certain functionality unavailable. However, GardePro will make every effort to avoid this.
Article 4 - USE OF PLATFORM
According to these Terms, GardePro grants You a limited, non-exclusive, and nontransferable license to download, install, and use the Platform for your personal, non-commercial use on your device(s); and to activate your camera, to manage and view photos and videos taken with your cameras; and to manage multiple cameras.
While using the platform, you shall not:
use the platform do something against the public order and good custom or not allowed by local low. Including but not limited to:
copy the Platform, except as expressly permitted by this license;
modify, translate, adapt, or otherwise create derivative works or improvements, whether or not patentable, of the Platform;
rent, lease, lend, sell, sublicense, assign, distribute, publish, or transfer Your access to the Platform, or any features or functionality of the platform, to any third party for any reason, including by making the Platform available on a network where it is capable of being accessed by multiple users under a single account;
attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Platform, the server on which the Platform is stored, or any server, computer, or database connected to the Platform;
Article 5 - ACCOUNT CREATION
To use the Platform, you are required to create a user account. You may be asked to provide certain registration details or other information, such as Your name, email address, mailing address, and phone number. If You choose, or are provided with, a user name, password, or any other piece of information as part of Our security procedures, You must treat such information as confidential, and You must not disclose it to any other person or entity.
GardePro will perform our duty to keep the Platform work properly and protect the user's information from being stealing by cyber-attack. You acknowledge and agree that GardePro cannot guarantee that unauthorized third parties will never be able to defeat the Platform's security measures, and get your information for improper purposes.
Article 6 - ACCOUNT PROTECTION
To protect data associated to your account, please protect your password of the account, and not disclose it to any other person. You may not use anyone else's account unless with the permission of the account holder. You acknowledge and agree that you are responsible for the safety of your own account and personal data.
Article 7 - ACCOUNT TERMINATION AND DISCONTINUATION
GardePro maintains the right to disable your user name, password or other identifier if You have violated the GardePro Terms. We will notify you by sending messages or in other methods. We also reserve the right to delete an account inactive (which is without any active plans) for a period of at least six (6) months, as well as any data associated to such account. Of course, the account holder will be notified before his/her data be deleted.
You may terminate or cancel your account on the Platform for any reason, at your sole discretion and without notice to GardePro.
Article 8 - ACCOUNT INFORMATION COLLECTION
From time to time, GardePro may access some of Your account data including images quantity, videos quantity and camera settings, in order to provide better service of the Platform, to perform troubleshooting, improve our Platform, or to review our system performance to You. Subject to these Terms, you grant GardePro a non-revocable license to use your account data and other content contributed to the Platform.
GardePro may also utilize third party vendors to provide some of the Platform to You, such as using a third-party payment processor to process your credit card or other payment method and payment information. GardePro will not collect, process or store your credit card information or other payment method.
You acknowledge that when you download, install, or use the Platform's GardePro App, GardePro may use automatic means (including, for example, cookies and web beacons) to collect information about your device and about your use of the Platform. All information we collect, or you provide, through or in connection with the Platform is subject to local Privacy Policy. It is a condition of Your use of the Platform that all the information You provide on the Platform is correct, current and complete. You agree that all information You provide to register with this Platform, including, but not limited, to through the use of any interactive features on the Platform, is governed by the local Privacy Policy and You consent to all actions we take with respect to Your information consistent with local Privacy Policy.
Article 9 - GARDEPRO WILL MAKE REASONABLE EFFORTS TO KEEP THE PLATFORM OPERATIONAL
However, at times Platform maintenance or other technical difficulties may result in temporary or long-term interruptions. These interruptions could be for issues outside of GardePro's control, including, but not limited to, issues involving Your cell phone network, your cell phone carrier, the removal of a previously existing cell phone tower, or Your internet service provider's issues. As such, Your content (including images and videos) may not always be available. You acknowledge and agree that GardePro does not warrant or guarantee network, system, or availability of the content (videos, or images), and will not be responsible for the event that all or any part of the Platform (or content) is unavailable at some time or for some period. In addition, GardePro cannot guarantee the preservation of Your images or videos, you may make a backup for the images and videos.
Article 10 - INVESTIGATION AND PROSECUTION
GardePro shall have the right to investigate and prosecute violations of the Terms of Service, to the fullest extent permitted by law. You acknowledge that GardePro has no obligation to review your Content or to monitor your access to or use of the Platform, but has the right to do so, to ensure compliance with the Terms of Service, applicable laws, orders or requirements of a court or governmental body. In case of violation of these Terms of Service, GardePro shall have the right to remove your Content and disable your access or use to the Platform without prior notice.
When you provide GardePro with your email address via the Platform, you expressly agree that GardePro will keep your email address in its databases and that GardePro may use such email address in its mailing list to communicate with you. We may verify certain information relating to your GardePro account, or keep you informed of the status of your account on the Platform, or conduct surveys or verifications relating to the Platform, namely its functionalities, user-friendliness or your appreciation of the Platform, or offer you advantages or promotions, or other purpose relating to the Platform or security of Users.
Article 11 - DATA PLAN SERVICE
Upon Your account and camera registration, GardePro takes steps required to provision the Data Plan. We may provide support for Your use of the Data Plan including technical support services and billing services (Support Services). The manner of delivery of Support Service may be adjusted by us from time-to-time. GardePro may utilize third parties to provide some or all of the Support Services to You. We may communicate with you including but not limited to email, telephone, or text message.
GardePro provides Data Plan and Support Services to our users. We are authorized to provide Data Plans by our Cellular Carriers, but Data Plans remain dependent upon Cellular Carriers and their respective roaming partners continuing to provide and support their respective networks and corresponding authorization. You acknowledge that Data Plans may be interrupted due to interruption of the cellular carriers and their roaming partner networks. You acknowledge and agree that data plan is available only within the applicable plan coverage areas, within operating range of wireless systems and with equipment authorized by cellular carriers to operate on its network. Further, GardePro shall be excused for its commercially impractical performance due to things out of its control, including but not limited to disruptions due to natural disasters, unavailability of third-party communications networks, acts of war, riots, strikes or supply chain shortages or delays.
Article 12 - PLANS
(1) Free Trial
- Each account is entitled to a one-month free trial for the first subscribed plan.
- The free trial applies only to the first plan added under the account. From the second month onward, the subscription will be billed according to the selected plan.
(2) Subscription & Billing
- Automatic Renewal: All plans are enabled with auto-renewal by default.
- Users can manage auto-renewal settings via the subscription page → top right menu Change → Manage Auto-Renewal.
- Billing Cycle: The billing cycle begins from the date when the first camera is added to the plan.
- Shared Data Pool: All cameras under the same plan share one unified data pool.
- Pricing Rule:
- The first camera is billed at the full plan price.
- Additional cameras on the same plan are billed at a fixed discounted price (e.g., Basic Annual Plan: first camera $67.2, each additional camera $48).
(3) Plan Changes
- Upgrade:
- Users may upgrade to a higher-tier plan at any time; the change takes effect immediately.
- Monthly → Higher Monthly: The photo limit increases immediately, while the billing cycle remains unchanged. The price difference is charged on a prorated basis.
- Monthly → Annual / Lower Annual → Higher Annual: The new plan takes effect immediately. The cost is calculated as the new plan price minus the prorated balance of the current plan.
- Annual Plan upgrades follow the same principle.
- Downgrade:
- Plan downgrade is not supported.
- To reduce a camera’s subscription, the user must remove it from the current shared plan and re-add it under a new plan. It is recommended to perform this near the end of the current billing cycle.
(4) Expiry
- If auto-renewal is disabled, the plan will terminate at the end of the current billing cycle.
- Once expired, the account will have no valid plan, and the user will not receive photos or videos.
Article 13 - TRADEMARKS
Trademarks that are used or displayed on the Platform are owned by GardePro on the Platform. These trademarks may not be copied or used, in whole, partial, or modified form, without the prior written approval of GardePro. In addition, GardePro custom graphics, logos, button icons, scripts and page headers are covered by trademark.
Article 14 - FEEDBACK
GardePro will be free to use, profit, disclose, publish, keep secret or otherwise exploit any comments, suggestions or other ideas to improve the Platform or other GardePro Product or Service ("Feedback"). You acknowledge and agree that we could use the feedback without compensation to the User or to person behind this Feedback.
Article 15 - USER CONTENT
You retain all ownership rights to images, text, graphics, videos, photos, information, or other materials ("Content") uploaded to the Platform. By submitting Content to the Platform, you acknowledge and agree that GardePro has the right to use or edit your Content for commercial and non-commercial purposes under the law of personal information protection policy.
You hereby acknowledge and agree that you are solely responsible for all Content that you submit to the Platform.
Article 16 - CONFIDENTIAL INFORMATION
The User may only use Confidential Information for the purpose of using the Platform and may not disclose Confidential Information to any third party, except is required by law.
Article 17 - TERMINATION BY GARDEPRO
GardePro may terminate or suspend your access to the Platform immediately with justification because of a breach of these Terms of Service. Upon termination of your access to or ability to use the Platform, your right to use or access the Platform will cease.
