Muhimma Digital Platform Co DMCC (Dubai) is a company incorporated pursuant to the laws of Dubai, United Arab Emirates (the Company). On this platform, we connect individuals (the user(s)) with enterprises and clients who reward users who facilitate exciting tasks completed in our mobile application. (the Muhimma App).

The terms and conditions set out in this document govern your access, registration and use of the Muhimma App on which they are posted. For the purpose of these Terms and wherever the context so requires, the terms ‘user’, ‘you’ and ‘your’ shall mean any natural or legal person who has attained the age of twenty-one and consented to register an Account or uses the Muhimma App in any manner whatsoever. Users under the age of twenty-one can use the Muhimma App only under the supervision (and; consent) of their parents and/or legal guardian.

The following terms and conditions constitute a legally binding contract between you and the Company and govern its use. Capitalized terms have been defined throughout this document under the clause dealing with Definitions.

The Muhimma App is available subject to you accepting these Terms of Use without any changes, modification or supplementary legal documents that are subject to amendment from time to time. It is important that you read these Terms of Use carefully before accessing the Muhimma App and more particularly before registering any Account thereon. By visiting, accessing, registering with, or using any part of the Muhimma App, you willfully acknowledge, agree and consent that you did read, clearly understand, agree and accept to be bound by these Terms of Use (the Terms).

The Muhimma App’s Team reserves the sole and absolute right to amend, modify, delete, add or change parts of these Terms without any notice. Any such changes or modifications by our Team will effectively soon after they are posted. Your continued use, or by performing an activity (of any kind whatsoever) on the Muhimma App implies your continued acceptance of the new Terms.

If you do not accept or agree to any of the terms and conditions set out in these Terms (whether in part or entirety), you should cease to visit and access the Muhimma App with immediate effect.

Eligibility Criteria

The Muhimma App is meant for and available for use by those who have attained at least 21 years of age. Users under the age of twenty-one can use the Muhimma App only under the supervision (and; consent) of their parents and/or legal guardian. Individuals and entities who cannot be a party to legally binding agreements should not use the Muhimma App.

To use the Muhimma App, you confirm you are a citizen or legally recognised resident (a UAE resident visa holder) of the United Arab Emirates. Visitors and users who are citizen of any country or state wherein access to the Muhimma App is illegal or prohibited by any applicable law, order, regulation or treaty should not use the the Muhimma App. Visitors who are a citizen or resident of any country or state where the United Arab Emirates or other sovereign country has placed sanctions or embargoes should not visit, access, register or otherwise use the The Muhimma App. Users and visitors who are a party of or subject to any criminal complaints, court claims, or subject to threatened actions should not access, visit or use the The Muhimma App in any manner whatsoever. Visitors and users whose citizenship or residence of their country changes will have to ensure that you comply with above terms and notify the Muhimma App Team about the same immediately.

Account Registration

Account (the Account ) registration is classified as User Account registration.

Every user is responsible for safekeeping of their respective login credentials. Maintaining confidentiality is also the responsibility of individual user .

Forgotten passwords will be encrypted but can not be retrieved. To reset a password, a User will need to submit a request form on the Muhimma App. Every user must immediately inform The Muhimma App Team in the event he/she becomes aware of any suspected activity or unauthorized access to their Account.

The Muhimma App, Rewards, Availability of Information and Waiver of Responsibility

Rewards and Awards

The Muhimma App is not in any manner whatsoever a party to any contract, dealings or conclusion of any project between Clients and Users. Clients set out the description of services or Tasks they wish Muhimma to facilitate. All Users must have a bank account registered in the United Arab Emirates. The Users accept the description of the Task and the pertaining rewards. Once completed and verified by the Muhimma App Team, the reward will be credited to the Users App Wallet, where the User can request to withdraw the balance to their bank account.

Muhimma strongly urges every User to verify and enter the correct UAE bank details in order for Muhimma to credit respective reward(s) to their account. Users requesting rewards to be credited to a UAE bank account to a non-user of Muhimma App, or a UAE bank account belonging to a third party, (User or Non User), should complete the Muhimma Bank Account Consent Form which has to be accepted, agreed and signed by both the User as well as the third party, other User or Non-User whose UAE bank account details are entered.

Users, you, hereby agree, accept and acknowledge that you wilfully consent to Muhimma App storing my information (including UAE account numbers or other banking information) and agree that this is at the Users sole risk and consequence. You further agree and accept that Muhimma App or Muhimma Digital Platform Co DMCC or its management or employee shall not (under any circumstances) be liable, responsible or otherwise be charged for any theft, hacking, malware, loss, or in the event the information mentioned herein is stolen by any third party (the Loss). By accepting this agreement, you hereby defend, hold harmless and indemnify the Muhimma App and Muhimma Digital Platform Co DMCC, its management, employees from each and all losses, costs, expenses, accidents, damages or liabilities incurred in connection with or arising from the Loss.

Muhimma has the right to forfeit any reward balance not withdrawn within 3 months of the last credit.

Muhimma has the right to ‘cap’ a Users maximum reward balance at 150 dirhams. Users must withdraw this balance within 3 months of the last credit to avoid forfeiting their reward.

Availability of Information

The Muhimma App has no control over and does not guarantee nor warrants the quality, safety, merchantability, legality or usefulness of any User Output performed, deliverables developed, marketed, sponsored, the transparency or accuracy of any statements, or qualification, expertise, background or abilities of the Users. The Muhimma App does not provide any assistance outside of the Live Chat support functionality within the app, such as materials, tools, gadgets, equipment to assist Users to complete tasks. The Muhimma Team reserve the right however, to verify whether a task is completed successfully and whether a reward for completion of a Task or Output can be granted.

Waiver of Responsibility

You acknowledge, accept, and agree that each and all responsibility, obligation and task to evaluate, to consider, to decide and to bear risks associated with the use of The Muhimma App (including without limitation assessment of other user or user profiles, certifications, claims made by any user) lies solely and exclusively with the user and that the Muhimma App or The Muhimma App Team shall not in any manner whatsoever and at any time be liable for any loss or damage of whatever kind.

Information as to description of services, Tasks or Outputs required by Client(s), is managed by the Muhimma App Team.

Electronic Signature

By signing up on the The Muhimma App and/or by clicking to accept The Muhimma App’s terms and conditions or these Terms, you are deemed to have accepted and executed these Terms, and other terms and applicable legal documents, immediately and upon your registration and acceptance, consistent with UAE’s Federal Law Number 1 of 2006 on Electronic Commerce and Transactions (as amended) (the Law ). Your registration constitutes an acknowledgement and acceptance that you are able to receive, save, download, or print these Terms, the other terms and conditions on The Muhimma App, including amendments. You shall also comply with Article 19 of the Law which clarifies duties of signatory in addition to Applicable Laws.

Ownership and License

The Owners of the Muhimma App (Muhimma Digital Platform Co DMCC) shall at all times retain ownership of the Muhimma App (inclusive of all content, intellectual property, legal documents, images, videos, keywords, algorithm, source codes and everything hosted thereon). The Muhimma App grants every user a non-exclusive, limited, revocable right to use provided you:

are in full compliance of these Terms and other agreements as applicable;
use your login credentials and Account details solely for you use and not to grant access to any third parties;
do not employ any device, software, viruses, Trojan horses, employ DDOs attacks, robots, or disrupt the operation, hosting or configuration of the Muhimma App at any time;
do not copy, modify, endanger, create derivative works, reverse engineer, employ third party software(s) that attempt to collect metadata, keywords or other sensitive information pertaining to the Muhimma App, reverse assemble or attempt to discover the source code;
shall not modify or attempt to modify the the Muhimma App (directly or indirectly) (with the exception of your self-generated content);

shall not defraud, spam, cheat, misled, misrepresent, blackmail, abuse any person or entity or incite violence in any form whatsoever;
comply with the laws of Dubai, the United Arab Emirates and all Applicable Laws; and
shall not violate the the Prohibited Items as below:

This includes content that is:

un-Islamic, blasphemous, lewd
that encourages sinful activity or that is aimed at corrupting minors etc.
negatively impacts social cohesion and peace
stirs sedition or sectarianism
mocks the leaders of the nation
hurts national unity or social peace

As a User you agree that care needs to be taken when submitting images of others online, on the web or on the Muhimma App

The UAE Penal Code makes it an offence to transmit someone’s photograph without their consent.

The Copyright Law states that, in the absence of an agreement to the contrary, a person who takes a picture of another cannot distribute or publish such picture without the consent of the person appearing in the picture.

You agree to indemnify the Muhimma App and The Company for any breaches of the Penal Code and Copyright law committed by yourself as the User or by a third party using your account with or without your consent

All user generated content shall at all times be deemed as works that are “made-for-hire” and the Muhimma App Owners (or Clients, as the case may be), not user(s) or visitor(s), shall own all the copyrights in Output created by User or Users and Muhimma App Owners (or; Clients as the case may be) be considered the legal author.

The Muhimma App will have the right and entitlement to exploit, copy, disclose, display, share, distribute, edit, create copies, create derivative works, improve or modify any user generated content you submit for any purpose or reasons whatsoever, without any restrictions or limitations, without any obligation, notification, consideration or compensation.

Intellectual Property and Proprietary Rights

Users are permitted to download or print one copy of any portion of the Muhimma App to which they have access to. Such download or print is limited purely and entirely to user’s personal and non-commercial use PROVIDED HOWEVER that the copyrights and proprietary rights in such prints or copies shall at all times vest with the Owners of the Muhimma App.

You further agree, acknowledge, accept and consent that:

The Muhimma App, information supplied on the Muhimma App and everything stored, displayed and hosted thereon is the proprietary property of the Owners of the Muhimma App, or its licensors with all right exclusively reserved;
No user, visitor, Client or Consultant is permitted to use, copy, display, reproduce, redistribute, market, publish, republish or market or sell any content available on the Muhimma App (whether in whole or in part(s)) without the prior written consent of the Muhimma App.
In line with provisions contained in the Digital Millennium Copyright Act, 1988, the Muhimma App, it’s Owner or Team will act immediately and respond expeditiously to all claims of copyright violations that are reported

Confidential Information

“Confidential Information” means each and all information related and pertaining to the Muhimma App, including all task requests on the The Muhimma App, and also includes (without limitation)

All information submitted by the Users including without limitation Account details, instructions, photographs, comments, input data, third party information;
Trade secrets, ideas, processes, know-how, improvements, designs, techniques, data programs (regardless of media on which they are stored), works of authorship, works of craftsmanship shared and communicated with us by Users outside of the App;

Exclusions from Confidential Information

Confidential Information does not include any data or information which is, or later becomes, available to the public without breach of any obligation owed by the receiving Party; which is demonstrated to have already been known to the receiving Party prior to its disclosure; which became known to the receiving Party other than by breach of a confidentiality obligation owed to the disclosing Party by the receiver; which was disclosed by the disclosing Party to a third Party without restrictions on its disclosure; or which was independently developed without breach of these Terms. In addition, the recipient shall not be considered to have breached its obligations under this Section for disclosing Confidential Information as required to satisfy any legal requirement of a competent governmental body provided that, immediately upon receiving any such request and to the extent that it may legally do so, the recipient advises the discloser promptly and prior to making such disclosure so the discloser may object to such disclosure, take action to assure confidential handling of the Confidential Information, or take such other actions as the discloser reasonably deems appropriate to protect the Confidential Information.

Warranty and Limitation of Liability

YOU HEREBY AGREE, ACKNOWLEDGE AND CONSENT NOT TO RELY ON THE MUHIMMA APP, ANY PAGES ON THEIR WEBSITE (INCLUDING INFORMATION SUPPLIED THEREON) ON THE MUHIMMA APP. THE MUHIMMA APP IS MADE AVAILABLE ON “AS IS” AND “AS AVAILABLE” BASIS. THE MUHIMMA APP, THE OWNERS AND TEAM MAKE NO EXPRESS REPRESENTATIONS, WARRANTIES OR STATEMENTS IN RELATION TO THE MUHIMMA APP, ITS CONTENT, INFORMATION MADE AVAILABLE, OR TO LEGAL DOCUMENTS AVAILABLE ON THE THE MUHIMMA APP. THE MUHIMMA APP AND TEAM DISCLAIM EACH AND ALL EXPRESS AS WELL AS IMPLIED CONDITIONS, REPRESENTATIONS, WARRANTIES, INFORMATION, AND DOCUMENTATION INCLUDING WITHOUT LIMITATION WARRANTY AS TO MERCHANTABILITY, ACCURACY AND FITNESS, TITLE AND NON INFRINGEMENT.

UNDER NO CIRCUMSTANCES SHALL THE MUHIMMA APP, ITS TEAM OR ITS THIRD PARTY SERVICES PROVIDERS BE LIABLE TO YOU OR ANY OTHER USER FOR ANY SPECIAL, PERSONAL, DIRECT OR INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES (OR RELIEFS OF ANY KIND WHATSOEVER) THROUGH THESE TERMS (OR OTHER LEGAL DOCUMENTS AVAILABLE ON THE THE MUHIMMA APP) INCLUDING WITHOUT LIMITATION LOSS OF BUSINESS, LOSS OF OPPORTUNITIES, BORROWING COSTS, LEGAL EXPENSES, LOSS OF IP, AND/OR LOSS OF GOODWILL. UNDER NO CIRCUMSTANCES WILL OUR LIABILITY TO YOU FOR ANY ACTION OR CLAIM PERTAINING TO THE MUHIMMA APP, OR THE MUHIMMA APP’S TEAM (REGARDLESS WHETHER SUCH CLAIM IS BASED ON A CRIMINAL ACTION, TORT, NEGLIGENCE, OR ANY THEORIES OF LIABILITY OR CLAIM EXCEED MORE THAN AED 300 (UAE DIRHAMS THREE HUNDRED).

Indemnity

You hereby agree to defend, hold harmless and indemnify the Muhimma App and the Muhimma App Team from and against each and all losses, costs, expenses, accidents, damages or other liabilities incurred by the Muhimma App from and against any cost, expense, tax, liability, loss, damage, cause of action, claim, suit, proceeding, demand or action brought by a third party against the Muhimma App or the Muhimma App Team: (1) dealing with or arising from your Task or Output resulting through use of The Muhimma App; or (2) resulting from

your use of the Muhimma App;

your act of engaging with other users;

your act of submitting a response or completed Task;

any breach, complaint or other claims made by other users alleging your conduct on the the Muhimma App;

your breach of any legal issue forming part of the Muhimma App;

your breach of these Terms;

any act or omission on your part.

Third Party Websites, Content and Links

The Muhimma App may from time to time provide links to third party content (including without limitation images, logos, pictures, illustrations, text, slogans, graphics, articles, designs, blogs, audio, music, video, sound, software, applications) or websites and applications (the Third Party Platforms ). The Muhimma App, its Owners and Team have absolutely no control on these Third Party Platforms. Users are urged to read, and familiarize themselves with their terms of service or terms of use. We do not monitor, check nor endorse or approve any Third Party Platforms, and are hence in no way responsible for any content outside the Muhimma App.

Whole agreement

These Terms (together with the other documents attached to or referred to in it) constitutes the entire agreement between the parties in relation to its subject matter and supersedes all previous agreements and understandings, whether oral or written, in relation thereto. Each party acknowledges to the other party that it has not agreed to enter into these Terms in reliance on any representation, warranty, assurance or commitment not contained in these Terms or, to the extent that it has, it hereby waives and releases all rights and remedies that it would otherwise have in respect of the same, otherwise than on grounds of fraud.

Definitions

“Account” means any account that a user establishes with the Muhimma App or its affiliates.

“Company” The Muhimma Digital Platform Co DMCC, the company registered before Dubai Multi Commodities Centre.

“Client” means corporate entities, brands, organizations, and persons requiring Tasks and Output from Users using the The Muhimma App and in consideration for a Reward agreed between the Muhimma App and the User.

“Client Agreement” means the agreement signed between the Owners and Clients.

“User” means users who have registered a valid Account on The Muhimma App.

“The Muhimma App” means the applications for mobile and tablet devices owned by the Company.

“Output” means any tangible and verified Output or Task that User has agreed to undertake and complete, including, but not limited to, all information of a scientific, technical or artistic nature, whether oral or recorded in any form or medium and whether or not subject to copyright, also including but not limited to samples, data, reports, surveys, photographs, collections of information, and any information.

“Owners” means the Company.

“Services” means the services requested by Client to The Owners which is shared and accepted by User for completion and forms an integral part of Output or Task.

“Team” means the Company’s management, employees and technical team.

“Terms” shall mean these Terms of Use.

“Third Party Platforms” means the Muhimma App’s link to third party content (including without limitation images, logos, pictures, illustrations, text, slogans, graphics, articles, designs, blogs, audio, music, video, sound, software, applications) or websites and applications.

Privacy Policy

Muhimma Digital Platform Co DMCC (the Company ) operates the mobile application (the Muhimma App ). The Muhimma App is an engaging and exciting experience to earn rewards and more using your mobile phone in helping great brands by completing fun and entertaining tasks.

Please read this document carefully as it sets out the type and form of information we collect, process, use, and transfer. Users under the age of twenty-one can use the Muhimma App only under the supervision (and; consent) of their parents and/or legal guardian.

The Company employs reasonable safeguards to ensure that user/your information that is personally identifiable is not compromised. The World Wide Web and Mobile Applications are not a secure sources or mediums and the privacy of individual user(s) cannot be assured. The Company does not have any control whatsoever over practices of third party applications or websites. By visiting and downloading the Muhimma App, you agree, consent and accept that the Company may use your personal information in lieu of providing services on the Muhimma App and to distribute, send, share marketing communications to you.

Information that Company Collects, Hosts, Receives and Uses

Account and User Profile Information

When you visit and use the Muhimma App, the Company may require, process, review, and use certain information. This information includes but is not limited to your name, age, gender, your phone number, interests, photos, geography, address, email address, bank account details, and related information. The information that you and other users share publicly is solely and exclusive your responsibility. We urge you to exercise care and caution in making, disclosing or sharing certain personal information in public domain. In cases where you log on to Muhimma App using third party authentication service such as Instagram, Facebook and other applications, we may also obtain additional profile information and other information that such third party authentication service authorizes us to obtain.

Although the Company makes every effort to preserve your individual privacy, the applicable laws may require us to disclose your personally identifiable information with enforcement agencies, government bodies, judicial or quasi-judicial bodies where we are bound to disclose such information to comply with laws and regulations. We may also share such information (in good faith, and acting reasonably) to investigate violation of our User Agreement or for any suspected illegal activity on Muhimma App.

When you perform any tasks for Muhimma, (and our affiliates) we may disclose your personal information in order for us or third parties to verify your responses. This information can also include your User ID, comments you or other users post, feedbacks, ratings and associated information.

Listings

The Company may host information including personally identifiable information, username and passwords to provide our services on Muhimma App.

Application and Mobile Data

The Muhimma App may automatically obtain and log information on Company’s servers from your device. This information includes without limitation your IP address, type of software used, device type, hardware attributes, pages you browse, mobile identifiers, information such as App usage, and device or system level information.

Additional Information

The Company may also append information which we obtain legally from our business partners or third parties to existing data or information that we hold and own about our users.

Information Pertaining to Cookies, Mobile Identifiers, and IP Address

We may acquire (or; collect) (whether automatically or otherwise) certain information through technologies such as cookies, pixel tags, web beacons and related tracking technologies. Your browser or mobile device may have the necessary settings related to the above technologies. Cookies are low sized text files that store information locally on your computer, mobile phone or other device(s). Pixel tags or web beacons are small blocks of various codes on a webpage or mobile app that allows reading, placing or appending cookies and transmitting information to us or our partners. These codes track once a pixel is loaded to indicate that user has used or engaged itself with a specific screen or page.

Cookies help you and other users in saving their preferences, notifications and settings on your computer, tablet, mobile phone or other device and these preferences and settings are automatically restored during your next visit. In sum, cookies are used (in addition to other technologies) for a more user-friendly experience.

We may allow third party sites and partner sites including advertising and marketing firms, analytics providers to obtain and receive information using different technologies on Muhimma App. The data and information we collect are subject to applicable privacy policies of those third parties.

Use of Information

The Muhimma App may use the information in several ways including without limitation: –

To provide our service;
to assist users with customer care inquiries and for technical glitches or to enable certain features;
to allow access to beta features and experiments;
for customizing offers and experiences including marketing and advertising (including third party advertisements);
monitoring individual activity of users and determine the keywords used to reach us, manage traffic, ;
to contact users including for service matters, newsletters via any communication channels;
to ensure the User Agreements are enforced; and
to carry out research initiatives and perform analytics to improve Muhimma Apps services;

Information We Share

The Company may share information it collects with affiliates (whether located domestically or otherwise). These companies may only process and use this information to assist us for the purposes described above and are bound to comply with this Privacy Policy;
We do not share personal information about our users with non-affiliated parties unless our user’s consent and permit us to do so;
We may share information with private or public authorities in matters involving compliance, fraud, network abuse and violations of law;
We do not rent, or sell personal information about users with non-affiliated third parties;
In the event that our business or a division of our business is reorganized or sold and we transfer all or substantially all of our assets to a new owner, your personal information may be transferred to the buyer to enable continuity of service.
We may share or disclose certain information that is non-personal in nature (it means such information will not identify the users individually) with third parties, partners or research agencies to better understand your interests, and improving overall quality and effectiveness of their services.
